A three-year moratorium on new data center planning approvals could take effect in Virginia starting July 1, 2027, under Senate Bill 843 filed by Democratic state senator Russet Perry of Loudoun County. The bill targets the largest data center market in the United States.
What does the bill propose?
SB 843 would bar Virginia state agencies from approving data center planning applications for 36 months from July 1, 2027. The window aligns with the 2028 and 2029 General Assembly sessions, giving lawmakers two budget cycles to write a permanent rule set for the sector. Perry's office framed the moratorium as a planning pause, not a permanent block.
Why does Perry want a pause?
Perry told the Loudoun Times-Mirror the industry has outpaced the rules meant to govern it. "This billion-dollar industry has grown unchecked and without guardrails for years while families face rising electric bills, massive transmission lines threaten our homes, schools, churches, and farms, and while we don't have anywhere near the infrastructure needed to protect our grid and meet the staggering electricity demands of these massive facilities," Perry said.
He added: "We cannot keep rubber-stamping new data centers when we can't even manage the ones already built. It's past time we put real protections in place for our communities, our natural resources, and ratepayers." Perry cast the bill as ratepayer and grid protection, not an industry shutdown.
How does the proposal fit local action?
Northern Virginia, anchored by Loudoun County, hosts the densest cluster of data center capacity in the US. Local governments have already moved. Loudoun County is implementing its own 12-month moratorium, and Prince William County is tightening planning controls on new builds. In August, Perry and Republican state senator Richard Stuart jointly called for a state review into groundwater strain caused by data center operations. The local-to-state pattern shows one market pushing rule changes at every level.
How does Virginia compare to other states?
Statewide data center moratoriums are already in force in New York, Texas, and Oregon. Other states have introduced similar proposals but have not enacted them. Virginia's bill would become the largest-market moratorium on the books if passed.
What has the governor done so far?
Governor Abigail Spanberger has stopped short of backing a moratorium. Last month her administration released a Data Center Accountability Framework. The framework prohibits non-disclosure agreements for new projects and orders state regulators to draft noise standards for data center operators. Spanberger's approach tightens disclosure without halting construction.
What happens next?
SB 843 must clear the Virginia Senate and House of Delegates before reaching Spanberger. The July 1, 2027 start date leaves roughly 18 months for legislative movement and gubernatorial action. The vote will test whether Virginia's data center politics have shifted from accommodation to restraint.
